CASE UPDATE - 5/14/12

The Nevada Labor Commissioner has rejected our request that he issue an immediate order that Wynn stop taking tips. You can read a copy of that decision HERE. Because Wynn is appealing Judge Cory's decision he would, under applicable law, very likely not have to actually stop taking the tips until the appeal is decided. We believe he should have had to put the tip money is escrow or post a bond to protect the dealers' money until the appeal was resolved.  The Labor Commissioner disagreed.  The Wynn is a very profitable and well capitalized corporation so presumably it will have no problem paying the dealers if it loses the appeal.

IMPORTANT UPDATE ON CASE - FEBRUARY 19, 2009

TODAY THE LABOR COMMISSIONER DIRECTED THAT A HEARING WILL BE HELD ON OUR CASE ON JULY 7, 2009 TO JULY 10, 2009.  HE ALSO EXPRESSED A DESIRE TO GET OUR CASE MOVING TO A RESOLUTION AS SOON AS POSSIBLE.  THIS IS GOOD NEWS AND ADDITIONAL INFORMATION WILL BE POSTED AS IT BECOMES AVAILABLE

IMPORTANT UPDATE ON CASE - JANUARY 15, 2009

A CONFERENCE WAS HELD TODAY WITH THE LABOR COMMISSIONER'S OFFICE.  MUCH TO OUR DISAPPOINTMENT, THE INDICATIONS WERE THAT NO HEARING WILL BE HELD IN THIS CASE IN THE NEXT ONE OR TWO MONTHS. ALTHOUGH NOTHING WAS FIRMLY DECIDED, THERE WAS A DISCUSSION OF HOLDING A HEARING IN AUGUST.  THE ATTORNEYS FOR THE WYNN WERE PLEASED TO HAVE A HEARING SET FOR AUGUST 2009 AND BY DOING SO SEEM TO INDICATE THAT THEY, AND THE WYNN CASINO, FEEL IT IS ADVANTAGEOUS TO THEM TO DELAY AS LONG AS POSSIBLE THE DEALERS' CASE.  LEON GREENBERG, WHO WAS IN ATTENDANCE AT THIS MEETING, URGED THAT AN EARLIER DATE BE SET, NO LATER THAN MAY OR JUNE AND IF POSSIBLE EVEN EARLIER.  A FURTHER MEETING WILL BE HELD ON JANUARY 28, 2009. WE EXPECT A HEARING DATE TO BE SET AT THAT TIME.

IMPORTANT UPDATE ON CASE - JANUARY 14, 2009

TODAY WE WERE ADVISED THAT THE LABOR COMMISSIONER IS ISSUING AN ORDER THAT WILL EXTEND THE "PAYBACK" PERIOD BY WYNN TO THREE YEARS FROM THE DATE THE LABOR COMMISSIONER DECIDES THE DEALERS' CASE. WHAT THIS MEANS IS THAT IF THE LABOR COMMISSIONER ISSUES AN ORDER BEFORE SEPTEMBER 1, 2009, AND THAT ORDER IS IN FAVOR OF THE DEALERS, WYNN WILL HAVE TO PAY BACK ALL OF THE TIPS WYNN TOOK FROM ALL OF THE DEALERS,  INCLUDING THE DEALERS WHO HAVE NOT FILED CLAIMS WITH THE LABOR COMMISSIONER.  THIS IS VERY GOOD NEWS IN TERMS OF PRESERVING THE CLAIMS OF ALL DEALERS.  THIS WAS SOMETHING THE ATTORNEYS RUNNING THIS WEBSITE FOUGHT HARD TO GET THE LABOR COMMISSIONER TO DO. NO OTHER ATTORNEYS ASSISTED IN THAT EFFORT WHICH WAS OPPOSED BY WYNN'S ATTORNEYS WHO WANTED TO SEE THE DEALERS' CLAIMS CUT OFF AND LIMITED. THE LABOR COMMISSIONER'S SIGNED ORDER ON THIS WILL BE POSTED SOON.


Read the Labor Commissioner's Order of January 14, 2009.  In that decision he agreed with Leon Greenberg's request of November 17, 2008 (below) that the Labor Commissioner hear this case for all of the Wynn dealers.  The Labor Commissioner agreed that as long as he makes a decision by September 1, 2009, all of the dealers will be subject to that decision. Read Leon Greenberg's Letter of November 20, 2008 to the Labor Commissioner - This letter seeks to force Wynn to turn over the names and addresses of the former Floor Supervisors and Boxmen who may be important witnesses in our case.

Read Leon Greenberg's Letter of November 17, 2008 to the Labor Commissioner and the Labor Commissioner's Letter of November 10, 2008 -  Leon Greenberg's letter seeks to have the Labor Commissioner make a clear committment to hear the case for ALL Dealers and for all tips taken from all Dealers since September 1, 2006.   The Labor Commissioner's letter explains that the Labor Commissioner does not want 500 dealers to file individual complaints.  It also explains that his office, if it determined that Wynn had violated the law, would likely initiate an audit of Wynn to collect all money owed to all of the Wynn dealers.  That letter failed to explain if such an audit would cover the entire time since September 1, 2006.   COPY HERE

Read the Adminstrative Complaint filed with the Labor Commissioner on behalf of all Wynn Casino Dealers.  Contrary to what certain other attorneys were telling the dealers, this Administrative Complaint was not rejected by the Labor Commissioner but accepted by him.  This Administrative Complaint will be the subject of the as yet unscheduled Labor Commissioner hearing.  COPY HERE
